Michaelia Cash: Labor’s assault on the small businesses of Australia has been both disturbing and relentless

The Albanese Labor Government’s assault on the small businesses of Australia has been both disturbing and relentless. As shadow minister for employment and workplace relations, I’ve fought against the Government’s radical industrial relations agenda which is wrapping small businesses in complexity and confusion and adding cost to their operations at a time they can least afford it. But what has escaped the attention of many are a number of legislative changes being made by the Albanese Government in my other portfolio of shadow attorney-general, that will also profoundly impact small businesses. That’s right, Labor’s Attorney-General Mark Dreyfus has brought new laws to the Parliament that are a further direct assault on small businesses. Most small business operators have no idea what they are in for. It seems the Government is only seeking to add to the pressure small businesses are under through a series of decisions that will drive up legal risk, and compliance burdens and increase insurance premiums. Ultimately, these costs will be passed onto Australian families. Two weeks ago the Government forced the Australian Human Rights Commission Amendment (Costs Protection) Bill 2024 through the Parliament. This is a Bill that changes the way that costs are awarded in discrimination claims. It means that, in the vast majority of cases, small businesses that face a discrimination complaint will never be able to recoup the costs of successfully defending a claim. It is not just businesses — it is also charities, schools, sporting clubs and individuals who are targeted by any kind of discrimination complaint. In some cases, because of the way the Bill is drafted, a business might even need to pay the legal costs for a person to make an unsubstantiated complaint. If a person makes a complaint on multiple grounds — which is very common — and one is upheld on a technicality, the small business needs to pay for everything unless they successfully argue that a very narrow exception applies. Further, it appears this cost regime can extend to claims that are not based on discrimination, such as contractual disputes. So long as at least one of the grounds of the litigation is a discrimination complaint, this costs regime may apply to the whole of the matter. This tilts the legal scales against small businesses. The committee that looked at this legislation heard evidence that this would likely drive up insurance premiums. In turn, these higher insurance costs will likely be passed on to customers. A second concerning piece of legislation for small businesses was the recently introduced slimmed-down amendment to the Privacy Act. Small businesses were worried that the Government would remove the small business exemptions to the Privacy Act and burden them with a complex new layer of regulation. The Government decided they wouldn’t press ahead with that change for now. However, one of the items that did make it into the Bill, and which received very little attention, was tucked away in the second schedule to the Bill. This is a new statutory tort for a “serious invasion of privacy”. Among other things, it means that any company or individual that “misuses information” can be sued. The explanatory materials make clear that misusing information can be as simple as collecting or storing information in a way that is said to invade privacy. The legislation expressly makes clear a person can sue without needing any proof of damage. Crucially, this is separate and in addition to the privacy regime. It applies to everyone. So, while small businesses might have been given a temporary reprieve from complex regulation with one hand, on the other hand they will now face substantially elevated legal risks. This is a significant new exposure. Every business, big and small, now faces the risk of being sued for misusing information. Class action lawsuits will likely follow. No doubt, in due course, insurance premiums will be driven higher, and businesses will need to incur costs and change service offerings to protect themselves. Another Bill that was introduced to the Parliament that raises concerns is a huge new piece of legislation that will cover over 90,000 businesses in a new regulatory regime. Its own costings say it estimates this will impose “an additional regulatory burden to businesses of $13.9 billion over 10 years”. This is the Anti-Money Laundering and Counter-Terrorism Financing Amendment Bill. The AML-CTF regime aims to create a hostile regulatory environment for terrorism financing and money laundering by making businesses meet regulatory obligations around customer identification and transaction reporting. Currently, the regime affects the big banks and some other entities that provide designated services. But the new Bill will expand this to cover real estate agents, law firms, accountancy practices and a range of other businesses. Money laundering is incredibly serious. But there are real questions about whether this Bill strikes the right balance. Most of the businesses to be brought into the tent are small businesses. These small businesses will end up paying real money in compliance costs, but the Government has not explained how they directly benefit. And in addition to the regulatory costs, in some cases, these businesses will now be exposed to criminal penalties if they breach the new regime. Despite two rounds of consultation papers and discussions, most businesses did not see the actual drafting of the Bill until a couple of weeks ago. The Government says the legislation is necessary for Australia to meet its international commitments. Australia next faces evaluation for its compliance with those commitments in 2026. But the Government says the legislation is urgent and is intent on rushing it through before the end of the year. With the imposts these pieces of legislation will burden small business operators with, Australians would be quite entitled to form the opinion that the Albanese Labor Government doesn’t get small businesses and doesn’t much like them.
