John Quigley riding in the helicopter of former Crown director John Poynton was a ‘poor error of judgment’

John Quigley should never have taken a ride in the helicopter of former Crown director John Poynton to that now infamous birthday party in Yallingup last December. It was a poor error of judgment from the State’s chief law officer and one of Mark McGowan’s most effective Cabinet ministers over the past 41/2 years. It’s been 11 days since Tim Clarke broke the story on the front page of The Sunday Times and the Attorney-General still hasn’t admitted his mistake. Whether the flight was a technical breach of the ministerial code of conduct can be debated, but what’s not in doubt is the public should expect better from their elected leaders. Worse, McGowan compounded the controversy with a bizarre excuse that raised more questions about the standards he demands from his ministers. In an estimates hearing at Parliament last week, Nationals MP Peter Rundle asked the Premier if he felt Quigley hitching a ride in the chopper met the code of conduct. “People have private lives. They go to functions and they go to dinner parties. I saw the member for Roe the other night at the Brownlow Medal event. That is his private life. If he wants to go to a birthday party, I am not going to question him about that,” McGowan replied. The problem with this response was that Poynton wasn’t just any old law school mate of Quigley’s. By the time of December’s chopper ride, Poynton had given evidence to a NSW inquiry into the suitability of Crown to hold a Sydney casino licence. That same month, Victoria’s gaming regulator announced it would conduct an investigation into Crown’s casino licence in Melbourne. On December 17, WA’s Gaming and Wagering Commission said it was awaiting the findings of the Bergin inquiry and its officers were working with regulators in other States on matters relating to Crown Perth. The future of Crown as the exclusive holder of WA’s only casino licence was a live issue — and Poynton was the only Perth-based director on the embattled company’s board. Even before Christmas it was obvious Crown’s WA licence would be scrutinised by authorities here this year and Poynton would be a witness. Just two months later, the NSW inquiry — which uncovered evidence criminals used a shell company set up by Crown Perth to launder money — found Crown was unsuitable to operate Sydney’s Barangaroo casino. Poynton was not criticised in the Bergin report but the NSW casino regulator put immense pressure on the businessman to resign, which he eventually did two weeks after a WA inquiry was announced. Despite all of this context, McGowan last week continued to insist his Cabinet colleagues were not “members of Parliament or ministers every minute of the day”. “People have private lives,” the Premier said. Ministers do have private lives, but that doesn’t mean they shed their responsibilities the moment they finish work for the day. Accountability to the public is a round-the-clock duty. If they can’t accept that, they should find a different job. Quigley repeated McGowan’s defence when it was his turn before estimates, arguing he hitched a ride in Poynton’s chopper before the WA royal commission had commenced. “It was a private helicopter ride, private time and private function,” he insisted. By the week’s end, the Premier appeared to have realised his own poor choice of words when he conceded, “You’re always a minister or a member of parliament”. It’s ironic WA Gaming and Wagering Commission chief casino officer Michael Connolly stood down from his job in February when it emerged he was a fishing buddy of Crown Perth’s legal and compliance manager. But the AG’s office cited a clause which states gifts are exempt from the policy if they are “given to ministers or their immediate families by family members or personal friends in a genuinely personal capacity”. Exactly who decides whether a gift is from a friend “in a genuinely personal capacity” is not prescribed in the document, leaving ministers with a get out of jail free card. Sorry can be the hardest word for politicians, but Quigley got it wrong on this occasion and he should admit that. Peter Law is State Political Editor
