Man accused of a dozen counts of child sexual assault granted bail despite prosecution concerns

A Warnbro man has been granted bail despite facing serious sexual assault allegations against his daughter. The 46-year-old man, who cannot be named, appeared before Rockingham Magistrates Court facing six charges of indecently dealing with a child over 13 and under 16, five counts of sexually penetrating a child over 13 and under 16, and one count of persistently engaging in sexual conduct with a child under the age of 16. Prosecutor Sen. Const. Mick Fallows told the court the prosecution would be opposing bail due to the “seriousness of the allegations”. It was revealed in court that the allegations involved his daughter and that at the time he was “drunk” and “can’t recall the incidents”. “The concerns we have is that he is the victim’s biological father and the risk of witness interference,” Sen. Const. Fallows said. Duty lawyer Claudia Smilovitis said there were conditions that could be imposed to “eliminate” the prosecution’s concerns. Magistrate Steven Malley granted bail under strict conditions including a $20,000 surety and a personal undertaking of the same amount, to reside at an address in the City of Rockingham and to report to Rockingham police station every Monday and Friday between 8am and 4pm.
