A 36-year-old man has been charged with the assault of his ex-partner after serious domestic violence allegations. Elijah Toufic Shalala faced Rockingham Magistrates Court via video link last Wednesday morning. Sgt Naomi Foster told the court that about 8pm on July 14, 2021, Shalala had been at the victim’s home drinking, when an argument erupted between the pair over the seizure of a vehicle. To avoid the escalation of the argument, the victim went to bed. Not long after the victim was woken by a very intoxicated Shalala, who wanted to continue partying. The argument then continued, this time Shalala picked up a mirror and proceeded to shove it in the victim’s face, yelling at her “you dog mutt”, with both hands around the victim’s neck choking her as she gasped for air. Sgt Foster said the victim was then dragged into the living room, where she was stomped on her back, had her hair grabbed and continued to be choked until she felt she was going to pass out. Her head was bashed into a wall and Shalala dragged the victim onto the couch and threatened her, saying “see these hands they’ve killed before if you want to f... with me”. The victim was taken to hospital where she was treated for her injuries. Magistrate Vivien Edwards said that Shalala’s behaviour towards the victim was both “violent” and “terrifying”. “She probably thought she was going to die,” she said. “(These are) extremely serious offences against a person that would expect to be loved and cared for.” Shalala pleaded guilty to all charges. He received an 18 month prison sentence reduced to 12 months suspended, which will be completed at home with GPS monitoring and mandatory programs.
