Alicia Kibby Casey sentenced after violent assault at Rockingham shopping centre

A Rockingham woman who left a security guard with a bloodied cheek has been told by a magistrate that her behaviour was “totally unacceptable”. Alicia Lyla Kibby Casey, 37, pleaded guilty to common assault and breach of bail in Rockingham Magistrates Court on August 18. Prosecutor Sen. Const. Jessica Anderson told the court that at 4.16pm on February 16, Kmart employees had seen Kibby Casey stealing from the store and alerted shopping centre security. The security guard followed her out of the store and into the parking lot, where he continued to ask for her personal details. She refused to provide information and was very hostile towards security. Kibby Casey reached for her shopping trolley, pushing it towards the security guards. The court heard she punched the security guard to the left cheek causing it to split and start to bleed. She was then held on the ground by security before being let go. On March 31, she breached her bail conditions after failing to appear in Rockingham Magistrates Court. Duty counsel Stacey Byrne said some of the facts were disputed by Kibby Casey. Ms Byrne said that there were two security guards assaulted. One was hit by the trolley and the other punched to the cheek, but that Kibby Casey accepts she carried out both assaults. “She says that when she was leaving she did take a jumper but returned it and had other items in her trolley with the receipt,” she said. “Shopping centre security followed her out to her car and she attempted to show her receipt, however, continued to be asked for her details. Ms Byrne said Kibby Casey was “embarrassed” and just wanted to “get away” from the whole situation. “She has been a victim of domestic violence which is why she reacts quite significantly in these kinds of situations,” Ms Byrne said. Ms Byrne said that Kibby Casey would significantly benefit from a community-based order to help her outstanding treatment needs. Magistrate Vivien Edwards said it was “totally unacceptable” to behave in this way but noted the personal circumstances that led to Kibby Casey’s reaction. She was handed a 12-month community-based order with supervision and program requirements with forfeiture of $1000 for the breach of bail and court cost of $137. 1800 RESPECT (1800 737 732)
