Tribunal grants cancer patient access to voluntary assisted dying in WA

A cancer sufferer has overturned a decision that barred him from accessing voluntary assisted dying in WA. The terminally ill patient, who was diagnosed with pancreatic cancer in April, successfully challenged the decision in the State Administrative Tribunal. The 72-year-old was originally knocked back on the grounds he hadn’t been a resident of the State for a period of at least 12 months prior to making his request. However, SAT president Justice Kate Glancy determined he was eligible; despite the fact he’d not been living in WA for almost all that period. “I have reached that decision because the totality of the evidence demonstrates that between 1982 and 2021, (the man) lived, worked and raised his family in WA on a permanent basis, had friends here, owned property here and had a driver’s licence in WA,” she said. “(He) left WA for an extended holiday but never intended to make any place other than WA his home. (He) had firm plans to return to WA after a period of travel.” The SAT helped the applicant, whose identity was protected, secure pro-bono legal counsel. The man and his wife had embarked in 2021 on a caravanning trip around Australia, like scores of other grey nomads. Justice Glancy said that following the “holiday of a lifetime” the couple had intended to return to WA, to “resume living permanently”. “While (he) and his wife would have liked to maintain a home in WA during their extended holiday, it was not financially viable for them to do so,” Justice Glancy said. After selling their home, they stored belongings with family and friends here. “Their intention was that those items would all be available to them upon their return to Perth at the end of 2023,” she said. “(While on their travels), a decision was made to stay for a time in Adelaide so that they could assist their younger son through some difficult times he was then experiencing. “Rather than stay in the caravan, a decision was made to sell it and buy into a lifestyle village. I accept that that was a financial decision which was made to ensure that they were able to obtain Centrelink rental assistance payments and to maximise their financial position for when they returned to Perth. Upon the man’s cancer diagnosis, he and his wife returned to Perth as soon as possible, arriving back on June 10. “I accept that at no time did either (he) or his wife regard the move from WA as permanent and that at all times they had a fixed plan to return to WA at a reasonably specific time, albeit that that time frame was adjusted somewhat . . . in order to provide support to their son. “The reason for the return to Perth being that he regarded WA as his home and wanted to be back here to spend his remaining time with family and friends in WA.” Justice Glancy said the applicant had maintained a physical and emotional connection to WA while absent from it during his travels. “The purchasing of the home in South Australia and the obtaining of a South Australian driver’s licence may mean that (he) might also be found to have been ordinarily resident in South Australia for some time. However, having a second place of residence does not preclude a finding that he was also ordinarily resident in WA.”
