After nearly twenty years of marriage, Nicole Kidman and Keith Urban are divorcing, a move now formalised through lengthy settlement papers that reveal how they will divide their assets and co-parent their children.

Just one day after news of their separation sent shockwaves across the entertainment world, The Nightly has obtained the divorce documents filed on September 30 in a Nashville, Tennessee court, revealing who gets what.

From the documents, Kidman comes out the winner, spending more time with her children and holding ultimate authority on decision making if the now split parties can’t reach an agreement.

The Oscar-winning actress cited “irreconcilable differences” as the reason for splitting from the New Zealand-born country music star, who is believed to have moved out of their Nashville residence earlier in the US summer.

The papers reveal that Kidman and Urban have spent quite some time meticulously working through every detail of the split, from custody arrangements and child support to the surprisingly specific matter of who gets the credit card points.

Their “Permanent Parenting Plan”, which was filed alongside a marital dissolution agreement, was signed by Urban on August 29 and Kidman on September 6, putting to rest any speculation that the separation was sudden.

The plan grants Kidman primary custody of their daughters, Sunday Rose, 17, and Faith Margaret, 14, with the children spending 306 days of the year with their mother and the remaining 59 with their father.

Here’s a closer look at some of the biggest revelations from Kidman and Urban’s shock filing.

Property tied up in trusts

The big question on everyone’s lips: what will happen to Kidman and Urban’s $60 million property portfolio?

According to the divorce papers, neither Kidman or Urban “owns real property titled in his or her individual name”, but rather holds property “through trusts, limited liability companies and/or other entities.”

Their real estate interests are “awarded to each party in accordance with the terms of such trusts, operating agreements, and other agreements between the parties, free and clear of any and all interest and claims by the other party.”

Furniture and art have already been divided

Jointly purchased items, such as furniture and art, have already been divided evenly between the couple.

However, assets acquired individually, for example, cars registered in each person’s name, will remain with their respective owner, with no dispute from the other party.

Both Kidman and Urban will retain the right to possess any other items of personal property that was acquired before their 2006 marriage.

Creative works protected

Kidman and Urban have agreed that each retains full ownership of their individual creative works, whether conceived before or during their mariage.

This includes compositions, scripts, songs, designs, films, recording and other artistic material, whether created solo or in collaboration.

Each will be solely responsible for any costs associated with their own work and will continue to receive any income, royalties, or benefits derived from them.

Maintain individual financial assets

Kidman and Urban maintain separate bank and investment accounts. According to the filing, each one is waiving rights to the other’s assets and are solely responsible for their own debts.

The same applies for professional entities, business interests, contractual rights and trademarks titled to either individual.

The pair have even gone down to the nitty gritty details, dividing up their hotel, airline and credit card points.

According to the filing, “Each party shall be and is awarded all right, title and interest in any and all hotel, airline and credit card points listed in his or her name as well as all hotel, airline and credit card points associated with all debt accounts for which he or she is responsible.”

Urban to see kids ‘every other weekend’

A detailed parenting plan, which has been co-signed by Kidman and Urban begins with a shared commitment, dictating that they will behave in a manor that will not be distressing to their children.

“The mother and father will behave with each other and each child so as to provide a loving, stable, consistent and nurturing relationship with the child even though they are divorced.”

“They will not speak badly of each other or the members of the family of the other parent. They will encourage each child to continue to love the other parent and be comfortable in both families,” it continued.

According to the terms of the agreement, Urban will have custody of the children “every other weekend” from 10am on Saturdays until 6pm on Sundays.

Urban will also get to see daughters Sunday Rose and Faith Margaret on Father’s Day each year, while Kidman will have the children every year for Easter and Mothers day.

During school holidays, Urban will get to spend time with the children during school holidays on years ending with an even number, but with conditions attached.

For example, in even-numbered years, Urban will have parenting time with the children during their Autumn holiday break. While, in odd-numbered years, Kidman will have parenting time with the children for all of their Autumn holiday break.

The same method applies for other school holiday breaks sprinkled throughout the year, with an “in writing” system in place for the longer summer break.

As for Christmas, even when it’s Urban’s year to have the kids for “winter break”, the children will go back to Kidman from December 26.

The parent ending their time with the children will be responsible for drop offs at the other parent’s residence in Nashville, unless it clashes with an extracurricular activity or school, in which case the exchange shall occur at that location instead.

Kidman and Urban have opted not to have parenting time supervised by a court appointed social worker.

Major parenting decisions to be made jointly

The documents state that there will be joint decision making on subjects like education, non-emergency healthcare, religious upbringing and extracurricular activity.

However, if the parties “do not agree on a major decision for either minor or child, (Kidman), shall have final decision-making authority.”

Urban pays all child support in advance

Kidman and Urban listed their income as “in excess” of $US100,000 per month.

According to the documents, Urban has already prepaid all child support obligations owed to Kidman, including all monthly child support amounts.

“(Urban) has already prepaid (Kidman) all sums for his share of nanny and other childcare-related expenses, private school expenses, and extracurricular expenses for the minor children through the date each child reaches the age of majority and graduates high school.”

Each page of the 20-page marital dissolution agreement was initialled by both Kidman and Urban, with Davidson County notary Marissa Moses Russ stamping the documents.
